So, the other day, I decide that I want to cash out a retirement policy from my first job. For a few reasons:

1. its losing money, not making any money.
2. I could use the money right now.

the only problem is that when I last checked, I was listed as 0% vested, so I could not touch the employER contribution, currently about $2400. I called to find out why, and after a few days (since the last time I tried calling my former employer and sending an e-mail to the person who could answer my question, I recieved no reply for at least 3 months), I find out this:

1. I am 0% vested.
2. to be 100% vested, I would have had to have 12 monthly contributions from the employer.
3. this information is available in the master contract, but not anything I recieved. in fact, my representative from ING (which the retirement policy is through) did not know this either.

so my arguments:

1. I was hired for a 10 month contract and fulfilled my contractual obligations completely.
2. I stated that I would be looking for another job (with the desire to work more than 10 months and make more than $20,000 a year when I have a Masters degree). as a result, they interviewed for my position and before I made up my mind, my position was filled. mind you, my direct supervisor stated that the "...Office would be happy to have you back."
3. I was never notified of this policy and it is not in any of the paperwork I recieved or any contract I signed. hence, how could I make an informed decision regarding this without knowing about it?

so, I ask you all, do I have a legitimate argument to at least get some of this money?

Dude, that sucks. Sounds like something the people I work for would do. They screwed me majorly out of like four hours or more of over time my second week in because I didn't have a regular clock in number yet. Bastards, but no one else would have me.
