but sometimes they are in so much pain they don't recognize their selfishness. True, they are only (or primarily) thinking about them selves, but its almost difficult to be angry at them, at least without considering the sheer amount of pain/emotion in general that was going through their heads when they made that final decision.

Sometimes it seems like positivity is pointless, and perhaps it ultimatley is, but at least during that small little bit of time, you were somewhat happy. use your time to do things that are stress relievers, read, art, drugs, whatever, cause once you do get a job, as good as it will feel to be working, you'll also be wishing you had some time to yourself. I'm sure people tell you this all the fucking time, but you're a super brainy guy, and brainy guys figure it out some way or another. if it means anything, i'll send good vibes your way.

and on bowers... well, i think you have it right. I was mostly referring to the morality of the law, mainly because i was so outraged by Scalia's decision. Although I realize that he was legally justified in his decision, morally its a different story. First, I agree that our legal system is largely based on the common or public morality. needless to say, this morality is often wrong (i.e. the hollocaust, etc). In chosing to uphold the gorgia law outlawing sodomy, Scalia used the pretext of commom morality, and its pertinence to the history of that law never being taken off the books. My problem is simply that I think Scalia is a stupid fuck. well, not really, maybe more manipulative than anything. It seems clear to me that the arguments against the georgia law (such as its violation of due process, 14th ammendment, equality, so on and so forth) were by far the most logical and sound, and thus, the georgia law should have been overturned by the sheer weight in comparison to Scalia's argument. What I think the reality of the issue is, is that Scalia, obviously a conservative man who is probably personally homophobic, knew the law well enough to make it work to his advantage.
Even if the commom morality arguemt were valid (they should have polled, or something...also, doesnt the fact that it had never been enforced say something?) this issue can be approached in a utilitarian manner and find that the georgia law (and others like it) is unconstitutional. its that simple.

Ok, i'm rambling but yeah, i agree with you entirely. I think Scalia's decision was based on personal prejudices, and written off under the pretense of "common morality," when in the end, while legally justified, I would argue that this decision is immoral.

It's worse then just an art class... it's a class for analyzing art and all this other shit behind it. I love it. I think I failed the midterm though.
