Patenting protects inventions only. If you want to protect your design, you can either register it as a design under the appropriate legislation in your jurisdiction or rely on copyright as an artistic work (assuming you're not planning on using the design in mass production). Under the Berne Convention, to which both the US and Australia are signatories, copyright need not be registered but subsists on original creation.
