rights are best b/c they good us good democracy - freedom of speech, assembly etc help insure that you get informed voters and good aggregate decisions.
that said... while i think that rights COME from political structures, i DO like the metaphysical "fiction" of rights-beyond-politics. the strong version of this story can be dangerous - as it shuts down compromise and promotes individuals. but sanctity for rights, as a cultural artificat, is useful in protecting (or limiting the need to even pro-actively defend) those rights....
