The owner of the kitty that gets locked out at night is the same guy whose kitten fell off the balcony a while ago, and he told my dad that if the kittens paw was broken from the fall, he was going to drown him in a bucket. Fortunately the kitten was relatively uninjured. I didn't know there were still people out there who would resort to drowning puppies and kittens.

I would steal it whilst it is locked out at night...
If you can't keep it, find it a good home in secret. People like that shouldn't own animals.
