So there is this nifty clause in the traffic infraction code in Michigan that basically allows police officers to fuck people without possible defense. It's called Basic Speed.
Observe.
In court today I was told that no matter how fast I was going the fact that I was in an accident indicates that I was going too fast...period.
Let's ignore the fact that the whole county was covered in black ice...let's ignore the fact that road conditions were so horrible that traffic was only flowing at 15 MPH's everywhere you went... let's ignore the fact that two people had spun out before me on a sloping hill and that there was another accident at the bottom of the hill... let's ignore the fact that the officer admitted to the fact that there were multiple accidents all over that he was fielding... The cold hard fact, according to the judge, is that because I chose to go out on a day when the conditions were bad, and the fact that I struck another car, is automatic proof of my guilt in the matter, and as such I was forced to pay my fine and lose my deductible from my insurance company...oh, and good bye to those points off my liscence too...
evil me...driving that day...what was i thinking? I should be drawn and quartered...
well, that's the feeling I got from the judge, who wouldn't let my witness speak up either... how am I supposed to argue with that kind of circular logic? By that estimation, any time any accident occurs the offending party is going too fast. How fast is too fast when you hit black ice on a hill and there are two cars already spun out? Should I have been riding my breaks? Or should I have just sat at home all day like a good little girl and ignored my obvious needs that require me going outside of my home... on a hellish day to drive....
Grrrr.... fuck... innocent until proven guilty indeed, I should have just paid the damn ticket two months ago, at least I wouldn't have wasted everyone's valuable time...

more pissed at the judge...had I questioned his logic I probably would have been fined another amount for contempt of court... So yeah... anyone getting a ticket for Basic Speed... you cannot in anyway fight it... there's no point, the judge will tell you you were driving too fast... and everything else is moot.

2. I didn't because i was an idiot. and the cop was nice enough to give me the smallest ticket possible. I had to have one because I did enough damage that night. I did do driving school so it wouldn't affect my points or car insurance. I just had to do a 4 hour online.
