Alright, so I'm having a problem hereif anyone has any inkling of labor laws and unpaid wage claims then your help is greatly needed
I quit my old job at ZARA on June 4th. I did not give them any notice (some of you know why-I referenced the reasons in some previous journals) and was told to pick up my paycheck on the next payday, on June 11th. I did and saw that the paycheck was less than what I should have gotten. I felt something was amiss and asked for the timesheets, which I was given. I tallied up the hours and indeed, I had been shorted normal working hours AND overtime. It appeared that the former women's manager (since fired) had made mathematical mistakes in adding up the hours.
I called the assistant manager over and showed her my findings. She was pissed (not at me, she and I were friends) and said she was going to talk to the manager. The store manager, Jen, told her to count the hours with me again to make sure. She did, and came to the same conclusion. She then was instructed to fax our findings to the payroll dept at ZARA'S corporate office in New York. She had me watch her fax the information so I could verify that she had done so. They told me to go ahead and cash my check that I had received.
They told me to come back that Monday, and that it should be taken care of by then. I ended up giving them a few more days and came back that Friday, the 18th. They said it wasn't in, and that it definitely would be in the next payday, June 25th. I had a busy week and came in on this past Sunday, July 4th, figuring that they had an extra week to get it in.
Of course, it wasn't in. I talked to the manager and she said that corporate had told her that they had fixed all the discrepancies in everyone's paychecks. Evidently, ZARA isn't too familiar with CA state labor law, which says that overtime is amassed after 8 hours worked in a day (not including a 1-hour lunch break). They thought it was after 40 hours a week, and shortchanged everyone and fixed it on the next pay cycle. But I still didn't have a check. The manager gave me the corporate phone number and told me to call themshe wasn't concerned with it at all and seemed irritated that I wanted my money.
I called the New York office Sunday and got an answering machine. I left my name, my number, the store I worked at and the problems with the $$$ on the machine, which says that they will call you back when they get the message. I called them again Monday and got the same thing. I have received no calls back whatsoever.
This isn't a ton of moneymaybe 50-60 bucks. But, goddamnit, it's money I earned and I want it. These guys are giving me the fucking runaround and it's been more than a month since I quit that godforsaken place.
I'm not sure how to go about thisdo I keep calling them?....file an unpaid wage claim against them (which I don't know how to go about doing)?...I just want my money!!
For fuck's sake, I really want this BS to be over with and just be done with this company.
