What we are talking about, in essence, is a property right. There is plenty of precedent about ex post procedure that satisfies due process. The repo depot man can come to your house and reposses everything you own before you get a lick of process. And that's totally consistent with the due process clause, as long as you get some ex post process.

I understand it's a dangerous proposition, but it can and should be managed properly. Anyway, it's doubtful that Lautenberg will get too far with this since we can't even get the NRA to agree to change the policies about retaining records.
